Home Care LINK Terms and Conditions

Definitions

Care Recipient (CR) is the person receiving non-medical home care.

Care Coordinator (CC) is the person(s) signing the Agreement and thereby responsible for paying for and customizing the Home Care Link service for the Care Recipient.

Caregivers are the non-medical persons the Care Coordinator has engaged to provide care for the Care Recipient.

 

Summary

Oversight Inc.’s Home Care LINK (HCL) service provides a real time connection between the Care Coordinators and the Care Recipient’s Caregivers. To achieve that goal and avoid any misunderstandings, the following Terms and Conditions apply to our service.

 

Preliminary Agreements

Home Care LINK is intended for non-medical home care use ONLY. It is not intended to be part of a CR’s medical record. Our monitoring system is intended to be used by non-medical caregivers and only for “informational use” by medical professionals.

The Care Coordinator warrants they have the authority from the Care Recipient to enter into this Agreement.

Oversight Inc. agrees to provide the HCL service in a professional and timely manner.

 

Service Plans

The Standard Service Plan includes the following:

  1. Software that permits the Caregiver to record their actions and observations including pictures and free-form notes; their daily time and attendance; and any required transportation.
  2. The ability for the Care Coordinator to send Important Timely Reminders to the smart device being used by the caregiver.
  3. Reports including a chronological report recording every Caregiver visit, and a time and attendance report for every Caregiver visit.
  4. End of Visit Observations Report
  5. Medication Reminders

 

Software

Oversight, Inc. provides the Home Care LINK service, but we cannot in any way guarantee the accuracy of the information recorded and sent by the Caregiver.

We do not anticipate many software updates, but if they are needed we will do that electronically at no charge.

 

Client Setup Required

Home Care Link can only be effective if properly customized (setup). The Care Coordinator will need to customize the service for their Care Recipient(s) to include the following information:

  1. Create and update agreed upon caregiver tasks commonly referred to as “Activities of Daily Living (ADLs)”.
  2. If desired, create a medication schedule.
  3. Create and update required caregiver Observations.
  4. Enter each Caregiver by name and provide them with their Personal Identification Number (PIN).
  5. Create and update “Important Daily Reminders.”

 

Intellectual Property

Oversight, Inc. grants you a limited, non-transferable, royalty-free license to use the Home Care Link software in accordance with the terms of this Agreement. We retain all intellectual property rights to our software.

 

Payments

Payments are to be made electronically using either a debit or credit card. Though we process through PayPal, you may use your own debit or credit card. There are no additional fees to you. It’s easy; just enter the required information and it’s done.

 

Termination

Since Home Care LINK is an internet based service, Oversight will automatically terminate your service 15 business days following the last paid date of monthly coverage. No termination letter is required. Payment is due on the first of each month for follow on coverage. Payments not received within 15 business days may result in termination of services until the account is brought current. We are not responsible for any losses or damages occurring because of a termination of services.

 

Mediation

We’ll do everything we can to make sure that there are no serious disagreements between us. If either of us feels that the other has breached our Agreement, the first step is talking with the other party to try to work out the issue. If that doesn’t resolve the problem, both of us agree to send a representative authorized to reach a resolution to a formal mediation before filing suit.

 

General Provisions

This Agreement and any attachments to this contract supersede any and all other agreements in any format between us. It is the whole and entire Agreement between us on this matter and cannot be modified except in writing and signed by both of us.

If there are any damages or any legal contests regarding this Agreement, damages will be limited to the amount of the Agreement.

If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of all remaining provisions. You cannot transfer this Agreement to anyone else without Oversight Inc.’s written permission.

Although the language is simple, the intentions are serious and this Agreement represents a legal and binding document under exclusive jurisdiction of the State of South Carolina.
